The original English text shall be the sole legally binding version.

1. Definitions

1.1. Data Controller” means the natural or legal person, public authority, agency, or other body which, alone or jointly with others, determines the purposes and means of the processing of Personal Data.

For the purposes of this Privacy Policy, the Data Controller is THE BRO TECH INC., a corporate entity existing under the laws of Ontario, Canada.

1.2. “Personal Data” means any information relating to an identified or identifiable natural person.

1.3. Platforms means Nutaku (https://www.nutaku.net/), Steam (https://store.steampowered.com/), or other approved platforms, which provide distribution and access to the Services.

1.4. “Processing” means any operation performed on Personal Data, such as collection, storage, use, disclosure, or deletion.

1.5. “User or you” means any individual who accesses or interacts with the Services through the Platforms.

1.6. “Applicable Privacy and Data Protection Laws” means all data protection and privacy laws and regulations that apply to the processing of Personal Data under this Policy, including but not limited to the EU General Data Protection Regulation (GDPR), the UK GDPR, Canada’s Personal Information Protection and Electronic Documents Act (PIPEDA), the California Consumer Privacy Act (CCPA), and any other similar privacy or data protection laws applicable in the jurisdictions where Users are located, as amended from time to time.

2. Data We Collect

2.1. We collect the minimum amount of Personal Data and other data necessary to operate the Services and provide you with сustomer support.

2.2. The Personal Data we collect is:

  • Information from the Platforms and technical information:
    • Your nickname: Used to identify you within the Services.
    • Your Platform User ID: A unique identifier assigned to your account by the Platform. This is necessary to save your game progress and manage your in-game account.
    • Transaction ID: Unique transaction identifiers sent by Platforms upon completion of paid transactions.
    • Automatically collected technical data: When you access the Services, our servers automatically receive certain technical information such as your IP address, device identifiers, and other log information. We may use this data to enable communication between your device and our servers, ensure network integrity, and for fraud prevention and security monitoring.
  • Information you provide directly to us:
    • Your email address: We only collect your email address if and when you contact our support team at support@thebrotech.zendesk.com.
    • Other data you explicitly provide: We may collect and process any Personal Data you explicitly provide, such as posts, chat messages, support requests, purchase details, or other information submitted by you.

2.3. We do not collect your real name, address, financial information, or other sensitive personal data.  We do not process payment information – all payment data is handled directly by the Platforms.

2.4. Some of the collected data, such as your nickname, Platform User ID, or Transaction ID, may not, on their own, be sufficient to directly identify you and therefore may not constitute Personal Data under applicable data protection laws, unless combined with other identifying information. Transaction IDs are used solely for internal referencing of purchases and are not directly linked to your identity outside the Platform. These elements are considered non-personal unless associated with other data that enables your identification.

2.5. We currently do not respond to ‘Do Not Track’ signals or GPC, as we do not engage in cross-site tracking or sales of personal data. If these standards are mandated by law in the future or our practices change, we will update this Privacy Policy accordingly.

3. How We Use Your Personal Data

3.1. We use Personal Data we collect solely to provide you with the Services.

3.2. Nickname, User ID, and Transaction ID are used to:

  • Create and manage your in-game account.
  • Save and sync your game progress.
  • Enable you to use game features.
  • Verify and process your in-game purchases.

3.3. Automatically Collected Technical Data is used to:

  • Enable communication between your device and our servers.
  • Ensure network and service integrity.
  • For fraud prevention and security monitoring.

3.4. Your email address and other information you provide directly are used exclusively to:

  • Resolve the technical issues you have reported.

3.4. We do not use the collected information for any purpose other than providing and supporting the Services.

7.2. Please be aware that the Platforms you use to access the Services collect data independently from us. Their data collection and processing are governed by their own privacy policies. We encourage you to review the privacy policy of any Platform you use.

7.3. We may share Personal Data with trusted third-party service providers who assist us in operating our Services (for example, cloud hosting providers, customer support ticketing systems, etc.). Any such providers process your data only on our behalf and under binding contracts that protect your information.

8. Artificial Intelligence Content

Our Services may include content generated with Artificial Intelligence (AI). No additional personal data of users is processed through AI tools. AI is used solely for creating in-game assets such as dialogues, artwork, or scenarios.

9. Data Retention

9.1. We retain your Personal Data only for as long as necessary to fulfill the purposes outlined in this Policy, and as required by law or by our agreements with the Platforms.

9.2. Nickname, User ID, Transaction ID: retained as long as you use the Services or until you request the deletion of your account.

9.3. Support emails: retained for a reasonable period to resolve your issue and for record-keeping, after which they are deleted.

9.4. User-Generated Content: retained as long as your account is active to maintain the integrity of community features.

9.5. Automatically Collected Technical Data: retained for a short period for security and troubleshooting purposes, unless a specific incident requires longer retention for investigation.

9.6. Violation Data: retained for the minimum amount of time needed for detection and investigation. If a Violation is confirmed, data is stored for the duration of the applicable statute of limitations or until any related legal case is resolved.

10. Your Privacy Rights

10.1. Depending on your location (particularly if you are in the EU, UK, or US), you have certain rights regarding your Personal Data:

11.2. In the unlikely event of a data breach that compromises your Personal Data, we will notify you and the relevant authorities as required by applicable privacy laws (e.g., GDPR) without undue delay.

12. Third-party Resources

The Services may contain references or links to third-party resources, including (but not limited to) information, materials, products, or services that we do not own or control. The collection of any Personal Data conducted through third-party websites or applications is governed exclusively by the respective privacy practices of those third parties. 13. Children's Privacy

Our Services are intended for adults only (18+ or the applicable age of majority). We do not knowingly collect Personal Data from individuals under the age of 18 (or the applicable age of majority). If we become aware that we have inadvertently collected Personal Data from a child, we will delete such information promptly.
